Welcome to TheCarBooking. These Terms of Service ("Terms") govern your access to and use of the TheCarBooking website and services (collectively, the "Service"). Please read these Terms carefully before using our Service.

Billing

Paid subscriptions are billed in advance on a monthly basis. You authorize us to charge your selected payment method for all applicable fees. All fees are non-refundable unless otherwise stated or required by law.

Price Changes

We may change our subscription prices at any time. Price changes will be communicated in advance and will take effect at the start of the next billing cycle.

Cancellation

You may cancel your subscription at any time through your dashboard. Upon cancellation, you will retain access to paid features until the end of your current billing period.

5. Acceptable Use

When using TheCarBooking, you agree to the following rules:

  • Comply with the usage limits specified in your subscription plan
  • Use your account only for your own business operations
  • Not share or transfer your account credentials to third parties
  • Not attempt to bypass security measures or usage limits
  • Not use automated tools to create multiple accounts
  • Not reverse engineer, decompile, or disassemble the Service
  • Use the Service in compliance with all applicable laws

Violation of these usage rules may result in immediate suspension or termination of your account without refund.

6. Data and Disclaimer

While we strive to provide accurate and reliable software, we make no warranties or representations regarding the accuracy, completeness, reliability, or timeliness of the Service.

The Service is provided as a tool to assist in managing your car rental business. You are responsible for verifying all bookings, payments, and business operations conducted through the platform.

We are not responsible for any losses, damages, or costs arising from errors in the software, including but not limited to booking errors, payment processing issues, or incorrect calculations.

7. Intellectual Property

The Service, including its original content, features, functionality, design, and underlying technology, is owned by TheCarBooking and is protected by international copyright, trademark, and other intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your business purposes.

You may not copy, modify, distribute, sell, lease, or create derivative works based on the Service or its content without our prior written consent.

8. Prohibited Uses

You agree not to use the Service:

  • For any unlawful purpose or in violation of any applicable laws
  • To infringe on the rights of others, including intellectual property rights
  • To transmit malware, viruses, or other harmful code

9. Limitation of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THECARBOOKING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED EUROS (€100), WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless TheCarBooking from and against any claims, liabilities, damages, losses, costs, and expenses arising out of or relating to your use of the Service or violation of these Terms.

11. Termination

You may terminate your account at any time by contacting us. We may terminate or suspend your access to the Service immediately for any reason, including breach of these Terms.

Upon termination, your right to use the Service will cease immediately. Provisions that should survive termination shall survive.
